MOTIONS to MODIFY

After a dissolution, as family circumstances change, a divorce decree may need to be modified. Private agreements between parents are not enforceable until approved by a court. Failure to provide the appropriate rights of visitation or the neglect of minor children by the custodial parent may necessitate a change in custody. Modifications could involve the parenting plan, orders for child support and changes in custody.

CHILD SUPPORT ENFORCEMENT

Many times, a parent ordered to make child support payments fails to pay the amounts ordered by the court. A separate action for contempt may be necessary to enforce the parental support obligation.

In circumstances where children are borne out of wedlock, an action to establish paternity may be pursued by either the mother or the father to establish rights of visitation and child support obligations.

GUARDIANSHIP and CONSERVATORSHIPS for MINORS

Guardianships and conservatorships for minors may be needed when parents, as a result of death, disability or other reasons, cannot care for their children. Limited guardianships are available for the limited purpose of enrolling children in schools and providing medical care without the necessity of parents waiving their parental rights.

PRE-NUPTIAL AGREEMENTS

Marriages between people that have accumulated individual property create unique issues with respect to the protection of those assets. A pre-nuptial agreement should be put in place to address those issues prior the time problems arise.
